He married, third, Sarah (Sally) Lambert, Apr 3, 1806.
His Revolutionary War records are on file in the National Archives in Washington, D.C., file number R 10, 865. They read as follows:
"State of Virginia, And County of Augusta:
"On this 27th day of November, 1832, personally appeared in open Court before the justices of the County Court of Augusta now sitting, Jacob Vanfossen a resident of said county aged 76 years the 9th day of September last, who being first duly sworn, doth on his oath make the following declaration in order to obtain the benefit of the act of Congress passed Jun 7th 1832--
"That he entered the service of the United States under the following named officers and served as herein stated.
"In the year 1776 he joined a volunteer company then forming, in his neighborhood about 20 miles from Philadelphia. This company were to remain at home and like minute men to hold themselves in readiness for imediate service whenever it might be required. They frequently assembled and were kept together only a few days and were then permitted to return to their respective homes. The Company officers were Jacob Wentz Captain, Christian Weaver Lieutenant, Benjamin Weaver ensign, and this declarant himself was first sergeant.
"In August 1776 they were assembled at the tavern of Jacob Wentz their Captain and marched to Philadelphia where they joined a body of men under the Command of Col John Bull -- Among the other officers were Major Robt. Curry & Adjutant William Armstrong. From Philadelphia they proceeded to Amboy, passing through Trenton, Princeton & Brunswick, and crossing the Delaware & Raritan rivers on their march. They were stationed at Amboy to prevent the enemy, who then held possession of Staten Island from landing at this place. They were employed for several weeks in digging entrenchments & complelled to work altogether at night in Consequence of the constant fire kept up by the enemy from the Island. And always paraded in the morning before day in their entrenchments. The soldiers suffered greatly from the unwholesomeness of the provisions, it was found that lime had been mixed with their flour by a Tory who owned a mill from which they had ben supplied.
"After remaining some time at this place they were permitted to return home, having been out he believes about two months--
"In September 1777 This Company were again called out -- Capt. Wentz at this time had been deprived of his commission and Christian Weaver their former Lieutenant appointed in his room. This declarant was also promoted to the office of Ensign which he continued to hold during the war. They assembled at Wentzes tavern about the 8th of September and were marched to Brandywine between 25 & 30 miles distant where they joined the American Army under the Command of General Washington. That they were in the battle of Brandywine fought on the 11th of September. In this action the Americans were entirely defeated and the whole army compelled to retreat.
"This declarant was also at the battle fought at Germantown on the 4th day of October 1777 in which the Americans were also defeated --
"He was also at the battle fought at Monmouth on the 28th of June in the year 1778.
"He was under arms from the time of the battle at Brandywine untill after the battle at Monmouth, a span of twelve months in all, except that being in the immediate neighbourhood of his home he was sometimes permitted to return there a short time.
"These were the most remarkable duties which he performed. His company continued always ready and prepared for special service during the rest of the war. Their mustering place was Wentzes tavern, where they could be paraded at any time on a short notice. He could not pretend to state all the minute particulars of his service. Sometimes when the enemy were in that part of the Country, as he stated before, the Company would be hastily collected and kept together only a few days.
"He knows of no person now living who served with him who can testify as to his service--
"He received a commission but cannot recollect by whom it was signed. He presented it for several years after the war, but it has been since lost or mislaid. He would further state that he was born on the 9th day of September 1756 in Worcester Township about 20 miles from Philadelphia then in Philadelphia County but now called Montgomery. He resided there till after the termination of the war when he removed to Augusta County Virginia where he has ever since resided & still resides.
"He has a memorandum of his age in a bible now in his possession copied from a record in a family bible belonging to his father. He would suggest the names of Rev William Wilson & Maj. John Crawford as persons to whom he is known and who can testify to his veracity & their belief of his services as a soldier of the revolution. He hereby relinquishes every claim whatever to a pension or annuity except the present & declares that his name is not on the pension roll of the agency of any state.
"Sworn to and subscribed the day & year aforesaid. (signed) Jacob Vanfossen
"We William Wilson, residing in the County of Augusta & John Crawford residing in the same hereby certify that we are well acquainted with Jacob Van Fossen who has subscribed and sworn to the above declaration & that we believe him to be 76 years of age. That he is reputed & relieved in the neighbourhood where he resides to have been a soldier of the revolution & that we concur in that opinion.
"Sworn to & subscribed the day & year aforesaid. (signed) Wm Wilson, John Crawford
"And the said Court do hereby declare their opinion after the investigation of the matter & after putting the interrogatories prescribed by the war department that the above named applicant was a revolutionary soldier & served as he states, & the Court further certifies that it appears to them that the William Wilson who has signed the preceding certificate is a clergyman resident in the County of Augusta & that Maj. John Crawford who has also Signed the same is a resident in the same county & that their statement is entitled to credit.
"I Jefferson Kinney, Clerk of the Court of Augusta County, in the State of Virginia, do hereby certify that the foregoing contains the original proceedings of the testimony in the matter of the application of Jacob Vanfossen for a pension. In Testimony whereof I have hereunto set my hand and seal of office, this 27th day of November A.D. 1832 and in the 57th year of the commonwealth. Jefferson Kinney
"Augusta County to wit.
"This 8th day of August 1833 Jacob Van Fossen personally appeared before me the undersigned, a justice of the peace for said county and made oath to the following amendment to his declaration made in the County Court of said county on the 27th Nov 1832 in order to obtain a pension for his revolutionary services --.
"That he was engaged in service constantly, from the first of August 1776 untill after the battle at Monmouth on the 28th of June 1778 comprising a period of now less than one year, ten months and 28 days. Only that he was permitted sometimes to return home during this time, being a volunteer and being in his own neighbourhood. He was not however engaged in any civil employment, during that span of time. He would state his particulars of service briefly as follows:
"His tour to Amby he was engaged for two months from time of his return untill about the first of September 1777 he was in no engagements with the enemy. but was allowed frequently to visit his home. He always however considered himself in the character of a soldier & returned to his place in the army whenever he was required. he had not time to engage in any civil pursuits from the first of September 1777 untill after the 28th June 1778. Enemy being in immediate neighbourhood he was constantly engaged in the most dangerous & difficult kind of service - he was in three service battles viz: at Brandywine. at Germantown and at Monmouth. besides some skirmishes. After the battle at Monmouth. the enemy left that part of the country and he did not perform any other services of such courageous during the war, tho his company always held themselves in readiness for service whenever they might be called out, and attended (?) regularly once a week - or sometimes once in two weeks. he would mention by way of explaining his declaration that at the time that was drawn, he had been advised that he was entitled to a pension for his services until the termination of the war. He therefore only thought it necessary to mention the most important particulars.
"During the whole term of his service his colonel was John Bull. Robt Curry, Major, and William Armstrong adjutant. the officers of his company mentioned in his declaration held their commissions untill the termination of the war. (i.e. after the promotion of Christian Weaver to the office of Captain about the 1st of Sept. 1777.
"Of the time curing which this declarant was in constant service he acted 13 month in the capacity of first sergeant. and the residue of the time (viz. 9 months & 28 days in the capacity of ensign -- This declarant believes he cannot specify his services now particularly, he finds it utterly impossible to mention each particular time he was permitted to return home and called out again. He can produce no testimony to prove that he served with a commission, having removed to Virginia after the war where he knew no person who served with him and who could testify as to his services --
"Given under my hand this 8th day of Augt 1833. Wm Young
"I do hereby certify that I have known the above named Jacob Van Fossen for upwards of 25 years. and that his character as a man of truth, has always been unimpeached, so far as I know. and that I believe his statement is entitled to full credence -- Wm Young
"State of Virginia Augusta County Court Clerks office to wit:

"I. L. Edwards Esq Commr of Pensions Dohr:
"On the 27th of November 1832 Jacob Vanfossen, a soldier of the Revolution, made a declaration on due form before the County Court of Augusta in order to obtain a pension for his services. Which declaration certified as required, is said to have been sent to your department and the application rejected.
"The lawyer who attended to the business has lost all the papers as well as his memory in relation to the application.
"We are consequently in the dark as to the reason of the refusal of a pension. The old soldier is now ver aged & infirm & dependent upon the cold charity of the world for the necessaries of life; He is exceedingly anxious to know why his country thus leaves him destitute & refuses to reward him in the smallest degree for his sacrifices & services in her defence -
"By reference to his papers you will find that he was in the battles of Brandywine, Monmouth & Germantown & suffered besides many privations. That he was a member of a volunteer company in Pennsylvania acting at first as Sergeant & subsequently as ensign.
"You will be doing a favor for which you will be held in grateful remembrance by this warn soldier if you will refer to his papers on file in your Office. & write me at an early day informing me why his application was rejected. If not then entitled to a pension as an office whether he was not entitled as a private, or if the law did not allow him pension then whether ther is any previous or subsequent act of congress which will embrace his case.
"I suppose a pension was refused on the ground that he was not in actual service six months. but does not the character of the company of which he wa a member remove that objection - to wit: minutemen who were always ready. were frequently called from their homes upon parade for several days at a time. & acting thus during the whole war when not in actual service. Were not their readiness for service & nearness to Philadelphia & other important points, reasons operating upon those who have the power to call them out to compel them to remain at home? If they are not entitled to pensions it is not their fault certainly.
"I know that this is asking much at your hands. but, I hope under the circumstances of the case you will give it both your willing and early attention,
"I am, very respectfully, your Ab. Servt. Nicholas K. Trout
"Pension Office, Sept 23 - 1844
"Sir: In the case of Jacob Van fossen, my letter of the 5th Dec 1834 to Mr. William Kenny, of Staunton, a copy of which I herewith enclose, will shew what is wanted. No papers in the case have been received since that date. Unless he can shew by the necessary testimony that he performed six months actual service, it is not in our power to grant him a pension."

It is probable that Susanna died about this time and that Jacob went to Augusta County, Virginia on a visit, for on Jan 1, 1787 he and John Henger witnessed a deed there.

The 1820 census for Virginia, Augusta County (Roll 132, p 235½), listed the Jacob Vanfossen family as 3 males under 10 (William and James), 2 males 10-16, 1 male over 45 (Jacob, 63), 1 female 10-16, and 1 female 26-45 (Sarah/Sally).
The 1830 census for Virginia, Augusta County, Northern Township (Roll 189, p 48), lists the Jacob Vanfossin family as 1 male 10-15, 2 males 15-20, 2 males 20-30, 1 male 70-80, Jacob, 73), 1 female under 5, 1 female 15-20, 1 female 20-30, and 1 female 40-50.
On Feb 14, 1833, Jacob and Sarah sold 100 acres on Middle River to Jacob Baylor for $1150.
A number of grantee and grantor deeds in the name of Jacob Van Fossen are recorded in Rockingham County. On Sep 18, 1840, and indenture is recorded between Jacob Van Fossen and Sarah, his wife, grantors of Augusta County and Joseph Helms of Rockingham County, grantee, concerning 71 acres by name of "McCullough's Tract," being part of the same tract which Jacob had purchased from McCullough and sold to Israel Shaver.

One member of the Sons of the American Revolution who claimed Jacob Van Fossen as his patriot ancestor was Larry Patrick Cornwell, 138085. Jacob was credited for duties as ensign, Pennsylvania Militia. The source citation was his military records, transcribed above. The National Society, SAR also cited, "Abstract of Rev War Pension Files p. 3592 by White."
During 1780 and 1781, Jacob was a tax collector in Worcester Township.
In 1781 his taxable valuation was 96 pounds; the tax was 1-1-11. His occupation was given as carpenter.
In 1782, his valuation was 102 pounds, the tax 0-14-7.
Also in 1782, he bought 27 acres in Worcester Township from his father, Peter.
In 1783, he was listed as having 27 acres, 1 horse, 2 cows, and 6 sheep.
Jacob and Susanna sold 27 acres on May 9, 1786. Jacob bought 7 acres in Norriton Township, which adjoins Worcester Township, on May 22, 1786.
It is probable that Susanna died about this time and that Jacob went to Augusta County, Virginia on a visit, for on Jan 1, 1787 he and John Henger witnessed a deed there.
The 1790 census for Pennsylvania, Montgomery County (Roll 9, p 25), Listed the Jacob Vanfussen family as having 2 males under 16 (Abraham, 15 ;and Jesse, 4); 1 male over 16 (Jacob, 33), and 3 females (Mary, Catherine, and Elizabeth).
Jacob and Mary sold seven acres in Norriton Township on Apr 18, 1793. On Jun 29, 1793, he bought another plantation in Norriton. Within two years the family moved to Augusta County, Virginia. On Mar 23, 1795, Jacob declared himself and son Abraham taxable in Augusta County.
On Apr 4, 1796, Jacob and Mary sold their Norriton plantation and thereafter Jacob appears no more in the records of Montgomery County, Pennsylvania.
On Nov 5, 1796, Jacob witnessed John Gardiner's will in Augusta County.
In 1798, he bought 100 acres on the north side of Middle River near Fort Defiance from William Allen for 130 pounds.
On Jan 28, 1799, Jacob Van Fossen of Augusta County, Virginia, oldest son of Peter Van Fossen acknowledged receipt of 140 pounds-11-8 from his brother Benjamin, administrator of their father's estate "in full satisfaction of my two shares out of said estate."
The 1810 census for Virginia, Augusta County (Roll 66, p 391), listed the Jacob Vanfosen family as 2 males under 10, 1 male over 45 (Jacob, 53), 1 female under 10, 1 female 10-16, and 1 female over 45 (Sarah/Sally).
In 1820, Jacob and Sarah sold the real estate of Adam Lambert to Philip Nevergall for $300. The deed does not state how they acquired the property. (Adam Lambert, Jacob's daughter Elizabeth's father-in-law, had died some three years earlier.)
In 1845, George Greiner and Julia Ann, his wife, "qualified" on the estate of Jacob VanFossen. George William Crawford was appointed guardian of John C and Caroline, minor (grand) children of Jacob.
The children of Jacob Van Fossen and Susanna -- were:
i Abraham, b. 1774
ii Catherine, m. -- Dixon
iii Elizabeth, b. May 20, 1783, m. Francis Lambert on Nov 25, 1801, d. Feb 4, 1851

She was born on 10 Sep 1879 in Clay Co., MO. She died on 12 Jun 1920 in O'Neill, Holt Co, Nebraska, USA.
Notes for Marion Wilson Spry:
Marion was the 4th son of Elias and Emily Rose Lambert Spry of Cass Co., Iowa. He was born near Lorah, Iowa on May 1, 1878. He worked as a farm hand until he met and married Ida Mae Carley on November 21, 1899, in Atlantic, Iowa. Ida Mae was born to Clinton and Emma Fidelia Carley, in Clay Co., Missouri September 10, 1879/1880.
They had 9 children. The first 4 were born in Iowa. Emily on August 16,1900; and Gladys on February 25,1902 were born on a farm near Anita, Iowa. Cecil on April 7, 1904 and Floyd on June 5, 1907 were born on a farm near Wiota.
The family moved to O’Neill, Nebraska in 1909. Relocated to a farm near Phoenix, about 18 miles North of O’Neill 4 years later. They bought this farm in 1914. Five more children were born to them Violet July 31, 1909; Roy on May 8,1912; Gale on January 25,1916; Clayton on July 3,1918 (who died May 23, 1919 of pneumonia. and Leland born March 17, 1920.
During their years at Phoenix Marion became a well respected and prominent member of the community. He was a gentle, soft spoken man, with the strength of his convictions; slow to anger, but not afraid to stand up for his beliefs. He was consulted on what was taking place in the community, and as we understand rode with the Posse, as well as being instrumental in setting up the Phoenix Cemetery. He was always ready to help his neighbors and family as much as possible.
In 1912 a cyclone went through the Opportunity and Phoenix area. As usual the family memories, and different documentation differ on minor points. There are 2 newspaper articles, funeral home records, and the stories told in the Spry and Carley families. Basically we have determined that the worst damage was done at Opportunity, where Ida Mae’s brother, Robert Ord, lived with his family. Opportunity was just a few miles to the West of Phoenix. Roberts house was picked up, carried a short ways with the family still in it, and set down again. Robert, his wife and 5 children tried to run to the potato cellar. They were picked up and carried away again. Robert Ord and Robert Jr. (under two years of age) were hit by debris, and Robert was knocked unconscious, while Robert Jr. was very badly injured. The 4 year old girl was pulled away and carried about a 1/2 mile. Mrs. Carley managed to gather the other 4 children and get to the celler. After the storm had abated the little girl was seen by a neighbor where she had been set gently down on a small hill, still clinging to her pet pig and dog. She was unharmed except for very minor bruises, caused by the hail. The little boy, Robert Jr. died 3 days later from his injuries. Robert Ord had a sever head wound and a broken back. The farm was completely destroyed. Besides what physical help he could give, Marion arranged for and paid for the little boys funeral.
The area of Opportunity Phoenix seems to have been plagued with superstition. Most of the stories were of mysterious lights. They appeared to be following the fence posts and dancing across the fields. There was a newspaper article telling these stories published in the 1980s. The stories didn’t seem to be happening at that time, but had been numerous and prominent enough to survive and interesting enough to have been written up as having happened in the past. We grew up hearing these stories from our parents and Grand parents. The one story we heard in connection with Marion was when he was riding with the Posse, who was looking for a horse thief. When they found him, someone had hung him on the framing of a bridge in the area. The Posse cut him down to give him a proper burial. When he fell into the water, Marion reached down to pull him out, with his riding gloves still on. When he got the man up on the bank, Marion’s glove was missing, and never found. It was said that the horse thief haunted the bridge. Many people claimed they had seen him still hanging there.
Ida Mae died June 12, 1920 of complications of surgery, about 3 months after Leland was born. Marion did his best to raise the children and keep the farm, with the help of the children. The best we can piece the story together now; By 1930 the depression had set in and the farm was no longer paying for itself. Marion left the children that were still at home to try and keep the farm together, while he went to O’Neill to find extra work. We cannot be sure how many children were still at home at that time. All had married except Roy age 18, Gale, 14, and Leland 10. We know that some of them lived at the farm for a few years after they married, but have no facts on who or how long.
On Aug. 19, 1931 Gale went to feed his horse. The horse was either stung by a bee or bitten by a sweat fly, and kicked out catching Gale in the upper stomach and lower chest area. He died of his injuries the next day.
By 1936 things had deteriorated to a point that they had to sell the farm and moved into O’Neill, where Marion worked for Emmit Crabb and Ray Calvert at their service stations.
In 1946 he moved to Bellingham Washington with his son Roy. They located near his daughter Violet, who had moved out there a few years earlier. In 1948 he broke his hip while fishing, and moved to a nursing home in 1950. He passed away from a 2 week illness on April 23, 1958 and was buried in Phoenix cemetery next to Ida Mae, Clayton and Gale.

He married CORA LUCILLE STEARNS, daughter of Archie Leon Stearns and Nina Catherine Pelmulder on 24 Dec 1927 in O'Neill, Holt, Nebraska, USA. She was born on 16 Jun 1912 in Spencer, Boyd Co, NE. She died on 14 Jun 1995 in O'Neill, Holt Co, Nebraska, USA.
Notes for Cecil Wilson Spry:
Cecil Wilson Spry was born April 7, 1904, on a farm in Wiota, Cass Co., Iowa. His parents were Marion Wilson Spry and Ida May Carley. He had three sisters; Gladys May, Violet Myrtle, Emily Fidelia; and five brothers ; Floyd Marion, Roy Melvin, Gale Raymond, Clayton Leonard, and Leland Orville.
The family moved to O’Neill, Nebraska in 1909 when Cecil was 5. Four years later they moved five miles Northeast of Phoenix, Holt Co. Nebraska (which was about 23 miles North of O’Neill) where Marion bought a farm.
Cecil had good and caring parents, but due to the times and circumstance got kind of a rough start in this world. He was born with a cleft pallet and hair lip, which was not repaired until he was around 13. He was only able to attend school through 3rd grade. He lost his Mother at age 16. He worked hard on his Father’s farm and grew into a handsome gentle young 5ft. 11 1/2 inches, weighing about 160 lbs. man. Had dark brown hair, clear blue eyes and an endearing smile; with an inner strength. What he lacked in formal education, he made up for in observing and learning along the way. He had a natural aptitude for Math and could figure problems in his head faster than most people could with pencil and paper. He could not tell you how he got the answers as to a formula or how you could do it, but he nearly always came up with the right answer. He could read and write enough to get along, but was not a good speller nor did he have good penmanship. His practical and common sense allowed him to make a a decent living, though he never got rich.
When he was 19 he met Cora Lucille Stearns, daughter of Archie Leon Stearns, a neighboring farmer. Cora was born on a farm near Spencer, Boyd Co, Neb. June 16, 1912; She was 13.
He decided he was going to wait until she grew up, and ask her to be his wife. The young people of the two families socialized together, dances, picnics, and community affairs for the next two years. In June of 1927 Cora turned 15. Cecil married her on Christmas Eve of that year, and took her home to live on his Father’s farm, as he was still working there.
When they left the farm a few years later Cecil tried his hand at many things. Working at a super market, running a movie projector, working for the State, working as a ranch hand, and driving trucks. He decided truck driving was what he wanted to do. He and Cora worked and saved until they could buy a truck. They were in business. Things went well for awhile and Cecil became a very proficient driver. He drove in the local Truck Rodeos until local drivers refused to drive against him. They said he was going to win anyway, so why bother.
Then their luck turned against him. He had an accident, lost his truck and his license was suspended for three years.
These were hard times for everyone. The economy was in very bad shape, and jobs were hard to come by. Cecil and Cora had started their family and there were children to be fed. Cecil did any kind of work he could find, sometimes walking miles and going without lunch to work at unloading the beer trucks at 50 cents a day. He would pick up coal along the Rail Road track, where it shook out of the cars, to keep them warm.
In the mean time his Father fell on hard times and had to sell the farm. He was working in O'Neill as a carpenter. Cecil was able to get enough work with him to manage to keep his family going until he could get his license back and go back to his second love, driving truck. He was never fortunate enough to own his own truck again, but made an adequate living at driving for others.
Winters are cold in Nebraska, but Cecil would get up before day light, walk more than a mile, sometimes with cardboard lining his shoes to keep the snow from coming through the holes in the soles, to get his truck and be away from his family a week or more at a time.
In 1954 his job at Tri-State was giving out. There was less and less work to be had. He was hauling eggs from Tri-State Produce in O’Neill, to Valley Produce and Egg in El Paso, Texas. Herman Golden and Murray Cohen owned Valley, and offered him a job. He and Cora talked it over and packed up what they had and moved. Cora hated to leave her family, but never hesitated to follow her husband, and do what they felt was necessary for their family.
They bought a house and a used car, and Cecil drove truck for Valley Produce until his health gave out. He drove truck for about 47 years. He drove in and out of 48 States of the Union and both Canada and Mexico. The younger drivers, just starting out, nick named him "The Old King". His last few years of driving was local hauling of cinders to build roads in the El Paso area.
Cecil died May 8, 1974 and is buried in Evergreen Cemetery, El Paso, Texas. Cora had his headstone inscribed "King of the Knights of the Road." With a memorial stone in Phoenix, Nebraska, next to his loving wife, who went back to their first home area in Holt Co. Nebraska after he died. She passed away June 14, 1995. She spent her last years in the O’Neill Nursing home. In the 21 years between their passing, I don’t believe she ever spent one day not missing Cecil.
Cecil and Cora never had a lot of money to give "things" to their children, yet the children never went without anything they needed. They taught them the honorable way of life by example. If any man ever gave his all for his family, it was Cecil Wilson Spry. He and Cora left their seven children a rich legacy of Honor, integrity and love which was taught by example every day. Each child was special to them in their own way, never one more than the other. The children were: 1. Bernard Cecil born March 2,1931 died March 13, 1989. Married Deloris LaVonne Schultz. Their children were Zane Bernard Apr.2,1951 died 2012. 2.LIVING. 3. Living. 4. Living 5. Janey Louise born Dec.11, 1945 died 2005. 6. LaVonn Kaye born Oct 22, 1947 died 2007. 7. Living.

Their children were Zane Bernard Apr.2,1951 died 2012. 2.LIVING. 3. Living. 4. Living 5. Janey Louise born Dec.11, 1945 died 2005. 6. LaVonn Kaye born Oct 22, 1947 died 2007. 7. Living.
